South Africa is facing a battle over who gets to decide where religious freedom begins and ends.
Michael Swain of Freedom of Religion South Africa joins The Truth Report to unpack the CRL Rights Commission’s controversial Section 22 process, the proposed regulatory framework for religious organisations, and why opponents believe it could open the door to unprecedented state control over faith communities.
Swain argues that forced registration, regulatory councils, sanctions and potential deregistration could fundamentally alter the relationship between churches and the state. He also explains why existing criminal laws should be used against abusive religious leaders instead of creating a new system governing religion.
The numbers also tell a striking story. According to Swain, more than 18,000 submissions had been made through Dear South Africa, with 97.8% opposing the proposals, while he says the Section 22 committee has presented a far more supportive picture to Parliament.
This conversation goes beyond Christianity. Swain warns that once government establishes the power to regulate religious expression, similar principles could eventually threaten journalistic, academic and political expression.
